LAWYERS ON YOUR SIDE™

injured at work

Many workers are injured at their job site on daily basis. Working with cranes, forklifts, scaffolding, heavy equipment, and toxic chemicals all pose danger to the hard working individuals who earn their living in the construction industry. Construction workers face some of the most dangerous working conditions in America. These dangers are increased when construction companies force employees to work overtime and under tight deadlines. When safety measures and OSHA regulations are disregarded to cut costs, and poorly trained temporary workers are hired, the risk of serious injury and death is greatly increased.

When you are injured on a construction site, there are a lot of things to think about and it may become overwhelming for you. Did the employer fulfill their obligation to provide a safe workplace? Did a third party bring in unsafe equipment? At M&A, we will help relieve the stress by helping answer all of your questions for you and your family so you can focus on your recovery.

construction companies

According to statistics compiled by the U.S. Bureau of Labor Statistics, there are more than 11,000 catastrophic, disabling construction injuries in the U.S. every year and more than 10% of all construction workers will suffer some degree of injury on the job. More than 1,500 construction workers are killed yearly and shockingly, most of these fatalities happen as a direct result of safety violations.

All construction companies are responsible to make inspections for safety on every commercial or private work site. If any conditions on the site are unsafe, the construction company can be held responsible for negligence. Sometimes the employer fails in their responsibility to provide a safe place to work; other times, a third party breaches the trust of a safe work place by providing a defective piece of equipment or allowing unqualified workers to do an important job.

If injured on a job site, who is responsible?

Check with your lawyer; generally, all entities and parties at fault are responsible for your injuries. However, if workers’ compensation comes to play, then your recovery might be limited.

If collecting workers’ compensation, can you still file a claim against other responsible parties?

If the responsible party is not related to the company subscribing to workers’ compensation, then you can bring a claim against them. There are subrogation issues that you need to be aware of, so consult with a lawyer.

What if your employer is at fault and no one else?

If your employer is 100% at fault, you have to see whether it is a subscriber or none subscriber. Your attorney can review your case and let you know you options.

What damages are recoverable in construction accident cases?

Plaintiff is entitled to recover damages for past and future medical expenses, past and future wage loss, past and future pain and suffering, and if it is deemed that conduct is bad enough, punitive damages (i.e., punishment damages against the defendant).
